The Site is provided for your personal, non-commercial use, to learn about MAF, our artists, our programs, and our events, and to engage with us as a visitor, subscriber, donor, or applicant. You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of the Site by, any third party.

You agree not to:

• Use the Site in any way that violates applicable law or regulation.

• Attempt to gain unauthorized access to the Site, its servers, or any connected systems.

• Introduce viruses, malware, or any other harmful material.

• Use automated means to scrape, harvest, or extract content or data from the Site without our prior written permission.

2) Intellectual property

All content on the Site, including text, photographs, videos, graphics, logos, and the design and arrangement of the Site itself, is the property of MAF or of the respective rights holders, and is protected by copyright, trademark, and other intellectual property laws.

Images and reproductions of artworks appearing on the Site are the property of the respective artists or their representatives and are displayed with permission. They may not be reproduced, distributed, publicly displayed, or used for any commercial purpose without the prior written consent of the relevant rights holder.

You may view, download, and print content from the Site for your personal, non-commercial use only, provided that all copyright and other proprietary notices are kept intact. Any other use of the Site's content requires our prior written permission. Requests may be directed to info@mackartfoundation.org.

The Mack Art Foundation name and logo may not be used without our prior written consent.

3) Donations

Donations made through the Site are processed by trusted third-party payment providers and are subject to the terms and privacy policies of those providers. MAF is a 501(c)(3) organization, and contributions are tax-deductible to the extent permitted by law. Unless otherwise stated, donations are non-refundable. If you believe an error has been made in connection with your donation, please contact us at info@mackartfoundation.org and we will work with you to resolve it.

4) Event registration and applications

When you register for an event, book a tour or studio visit, or submit an application through the Site, you agree to provide accurate and complete information. We reserve the right to decline or cancel registrations and to modify or cancel events, in which case we will make reasonable efforts to notify registered attendees.

5) User submissions

If you submit materials to us through the Site, such as an application, portfolio, inquiry, or feedback, you represent that you have the right to share those materials and that they do not infringe the rights of any third party. Applications and portfolios are handled in accordance with our Privacy Policy. We do not claim ownership of materials you submit, but you grant us permission to use them for the purpose for which they were submitted.

The Site may contain links to third-party websites, including those of our artists, partners, and payment providers, as well as embedded content from platforms such as Instagram and YouTube. 10) Governing law

These Terms of Use are governed by the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms of Use or your use of the Site shall be brought exclusively in the state or federal courts located in Kings County, New York, and you consent to the jurisdiction of such courts.

11) Changes to these Terms of Use

We reserve the right to change these Terms of Use due to significant changes in the law, new technical solutions, new or improved features, or improvements to the Site. The date of the latest revision appears at the top of this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised terms.
